1) Who we are

The BigFive.ly website and Services are provided by GLORIAPR LTD ('BigFive.ly', 'we', 'us', 'our'), a company registered in England & Wales (No. 16313878) at 182-184 High Street North, London, E6 2JA, United Kingdom.

2) Acceptance and Eligibility

By accessing or using the website or Services, you accept these Terms.

You confirm that you are at least 18 years old, or the age of majority where you live, and that you have authority to bind any organisation on whose behalf you act.

3) Definitions

Services means the BigFive.ly website, the free test, paid reports, My Profile, BigFive Companion, and related features we make available through the platform, including account, result, Growth, Share, Compare, sharing, retrieval, support, and billing flows.

Report means a personalised B5+ digital report generated from a test or result identifier.

My Profile means the private authenticated account space that lets a user manage a saved result and related features such as Growth, Share, Compare, and Companion from one shared account.

Companion means the BigFive.ly conversational AI service made available through that authenticated account experience.

Companion Free means the no-charge Companion tier.

Companion Plus means the paid recurring Companion tier.

Private Chat means a Companion mode designed not to add that conversation to chat history or the memory library while still processing it to generate a reply.

Result Link means the attachment of a Big Five result to a shared My Profile and Companion account or to a Companion thread for personalisation.

Profile Share Link means a public link generated from a published My Profile share card.

4) Services We Provide

The Services may include the free Big Five test, result pages, paid B5+ reports, My Profile, BigFive Companion, result sharing and retrieval features, optional Google-linked save flows, support and feedback channels, and promotional or public onboarding flows such as newsletters, lotteries, waitlists, or reseller signups where offered.

My Profile may include features such as Growth, Share, Compare, and links into Companion.

Features, packaging, limits, and availability may change over time.

5) Free Test, Paid Reports, My Profile, and Companion

5.1 The free test provides immediate on-screen results; no purchase is required.

5.2 Paid reports are personalised digital content generated from your test or result data and normally delivered by secure link or email.

5.3 My Profile is the private account space that lets you keep one primary saved result and return to Growth, Share, Compare, and Companion from that same account.

5.4 Companion is an account-based AI feature inside that broader experience and may use your current message, attached result, saved preferences, prior regular chats, thread summaries, and saved memories, where available, to generate a reply.

5.5 Private Chat is intended not to add that conversation to chat history or the memory library, but it is still processed to generate a reply and may still use existing saved context.

6) Companion Plans, Trials, and Subscriptions

Companion may be offered in multiple plans, including Free and Plus.

Companion Plus is a recurring subscription billed in advance on the interval shown at checkout until cancelled.

Trial availability, trial length, payment-method collection, renewal timing, and eligibility restrictions are shown at checkout or in the billing flow.

We may limit duplicate or abusive trial attempts and use account, billing, session, security, and pseudonymous identity signals to enforce those restrictions.

If we describe access as unlimited, that means subject to fair use, security controls, abuse prevention, and technical limits.

7) Pricing, Taxes, and Payment Processing

Prices are shown at checkout or in-product at the time of purchase or subscription.

Payments are processed by Stripe or another payment provider we designate, and you authorise the applicable charges to your chosen payment method.

Prices may include taxes where applicable, and you remain responsible for any bank, FX, or card-issuer fees.

8) Refunds, Cancellations, and Downgrades

All B5+ report sales are final because they are personalised digital content supplied immediately.

EU/UK consumers: by paying for a personalised digital report, you request immediate performance and waive the 14-day withdrawal right once generation begins, to the extent permitted by law.

Companion subscription fees are non-refundable except where required by law or where we expressly agree otherwise.

You may cancel Companion Plus through the billing portal or another cancellation method we provide. Cancellation normally takes effect at the end of the current billing period.

If a trial ends without a valid payment method, if a payment fails, or if a subscription is cancelled or expires, Companion may cancel, downgrade, or revert to Free or limited functionality.

9) Result Linking, Profile Sharing, and Account Claims

You may only attach, claim, retrieve, reset, compare against, publish from, or otherwise use results and report links that belong to you or that you are otherwise authorised to use.

A result may only be linked to one shared My Profile and Companion account at a time.

We may refuse, block, unlink, reset, revoke, or investigate result access or profile-sharing activity if we reasonably suspect fraud, mistake, abuse, unauthorised use, or account-security risk.

If you publish a My Profile share card, you are responsible for the decision to make that output public and for sharing the resulting public link.

10) User Content and Service License

You retain rights in the content and data you submit to the Services, but you grant us and our service providers the rights reasonably necessary to host, store, process, transmit, summarise, transform, and use that content to operate the Services, generate reports, render My Profile features, generate Companion replies, maintain chat history, support memory and personalisation features you enable, respond to support requests, improve safety and reliability, prevent abuse, and comply with law.

11) My Profile, Memory, Chat History, and Private Chat

My Profile may store account-linked profile state such as a primary saved result, Growth records, and published or revoked profile-share records.

Regular Companion chats may be stored in your account history.

If memory is available on your plan and enabled by you, Companion may also store durable profile details from regular chats to personalise future replies.

Private Chat is designed not to add that conversation to chat history or the memory library, but the conversation is still processed to generate a reply and existing saved context may still be used.

Where offered in-product, you may permanently delete individual chats and saved memories from the live account experience. Deleting a chat does not delete separately saved memories, and deleting a memory does not delete chats where that detail may have been discussed.

12) AI Output Limitations

Companion replies are AI-generated and may be inaccurate, incomplete, inconsistent, biased, offensive, or unsuitable for your situation.

You are responsible for evaluating important outputs before relying on them.

13) No Therapy, Crisis Support, or Professional Advice

The Services are informational and educational only. They do not constitute medical, mental-health, therapy, crisis-response, legal, financial, employment, hiring, or other professional advice.

Companion is not a licensed professional, not a therapist, not a healthcare provider, and not an emergency service.

If you may harm yourself or another person, or if you need urgent help, contact local emergency services or a qualified professional immediately.

14) Prohibited Uses

You must not use the Services unlawfully, infringe third-party rights, scrape or automate access without written consent, reverse engineer our systems except where law does not allow us to restrict it, impersonate others, evade quotas or service protections, misuse trial access, submit harmful or abusive content, or resell or redistribute reports or paid access without permission.

15) Availability, Quotas, Fair Use, and Changes to Services

We do not guarantee uninterrupted or error-free availability.

Access may be interrupted for maintenance, security, provider outages, abuse prevention, or force-majeure events.

We may enforce quotas, rate limits, fair-use rules, and other service protections, including limits tied to your local time or account state.

We may add, remove, suspend, or modify features, packages, promotional flows, and public onboarding flows over time.

16) Privacy and AI Processing

We process personal data in line with our Privacy Policy.

Our service providers may include hosting and infrastructure vendors, Google for authentication or save flows, Stripe for billing, email and support tools, analytics or advertising providers where consent applies, and AI providers, currently including OpenAI API services, used to generate Companion replies and related features.

That processing may support test, report, My Profile, Growth, Share, Compare, Companion, retrieval, and billing functionality.

Where personal data is transferred internationally, we rely on recognised safeguards where applicable.

17) Suspension, Termination, and Account Deletion

We may suspend, restrict, downgrade, unlink results from, revoke public share outputs from, or terminate access to the Services if you breach these Terms, misuse the Services, create legal or security risk, fail to maintain required payment status, or if we are required to act by law or provider obligation.

If account deletion is offered in-product, deleting the shared account removes the live My Profile and Companion account profile and active content associated with that account, including saved profile state, Growth records, published or revoked share-card records, stored chats, memories, feedback, linked context, active sessions, and the active billing profile.

However, we may retain limited hashed, pseudonymous, or anonymized records where reasonably necessary for legal compliance, tax and accounting, dispute handling, fraud prevention, security, service integrity, usage enforcement, and trial-eligibility or anti-abuse controls.

Cancellation of a paid plan and deletion of the shared account are separate actions unless we expressly state otherwise in the deletion or billing flow.

18) Intellectual Property

All intellectual property rights in the website, Services, algorithms, software, report templates, branding, and related materials remain ours or those of our licensors.

We grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the Services for lawful personal or internal business purposes, subject to these Terms.

19) Disclaimer, Limitation of Liability, Severability, No Waiver, Assignment

To the maximum extent permitted by law, we exclude implied warranties.

Our total aggregate liability for any claim arising out of the Service giving rise to that claim is limited to the amount you paid for that Service.

We are not liable for indirect, consequential, special, punitive, or exemplary damages.

Nothing in these Terms limits liability that cannot be limited by law.

If any provision is unenforceable, it will be modified to the minimum extent necessary and the rest remains in force. No waiver is implied by delay or failure to enforce. You may not assign these Terms without our written consent, and we may assign them in connection with a merger, acquisition, or asset sale.

20) Governing Law, Disputes, Changes, and Contact

20.1 These Terms and any non-contractual disputes are governed by the laws of England & Wales.

20.2 Exclusive jurisdiction: courts of England & Wales, subject to mandatory consumer-protection law.

20.3 United States users: disputes will be resolved by binding individual arbitration under AAA Consumer Arbitration Rules; no jury trial or class action, except individual small-claims matters.

20.4 We may update these Terms from time to time. The Last updated date will change and material changes will be notified on the site or by email.
